PLATINUM COMMUNITY EDITION LICENSE (PCEL)

IMPORTANT – READ CAREFULLY: this is a License Agreement between you, “the USER” (either as individual or as a registered entity) and OMNYS S.r.l. for the SOFTWARE PRODUCT mentioned above. By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, then DO NOT install or use the SOFTWARE PRODUCT.

1. Ownership

The Software is owned by OMNYS and is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

2. Grant of license

OMNYS grants you a free, time-unlimited, non-exclusive and non-transferable license to use the software product and any eventual associated documentation according to the specific restrictions stated at point 3. below.

3. Restrictions of use

The Product Community Edition can be solely used for the following purposes:

for development
for technical evaluation
for Product demos
for training about the Product
to manage Internet / Intranet sites in production ONLY IF the Internet / Intranet site is related to one of the followings:
- User’s site as individual
- No-profit organization’s site

Any other use of the Product Community Edition is expressly prohibited. Should you have any doubts or need help about your Community Edition license, please do not hesitate to write to: support@omnys.com

4. License conditions

You are not authorized (i) to copy all or part of the Software Product nor the technical and any other support documentation granted in use, (ii) to license or sub-license the Product to third parties, or to provide other parties for any use at any title, except what stated at point 3. above. On all of the software and documentation references highlighting OMNYS’ ownership and intellectual property rights are reported. You are not allowed to remove such references. OMNYS is authorized to carry out automatic check of all licenses.

To protect its image and intellectual property, OMNYS can disable the software installations if the User’s behavior is not in accordance with the current License Agreement.

5. Terms of license

The Platinum Community Edition comes with:

No support by Omnys
No maintenance by Omnys
No warranty: the Community Edition is provided on an “as-is” basis and does not provide any warranty whatsoever. Omnys does not warrant that Platinum Community Edition’s operation will be uninterrupted or be error free. The software may be subject to failures and has not been developed to be used in risky environment requiring fail-safe products.

The Platinum Enterprise Edition License (PEEL) offers support, maintenance and warranty by Omnys or its Certified Partners.

6. Limitation of Liability

To the maximum extent permitted by law, in no event shall Omnys be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use or inability to use the Software, even if Omnys has been advised of the possibility of such damages. Omnys is not liable for any damages caused by any irregularity or down related to the Internet connectivity (Network Provider).
